Acceptance of Terms

These Terms & Conditions and End User License Agreement ("Terms" or "EULA") govern your access to and use of the Gigster mobile application and all related services (collectively, the "Platform"), operated by Gigster ("we," "us," or "our").

By creating an account, downloading the app, or using Gigster in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Platform Description

Gigster is a job networking and recruitment platform that connects employers with job candidates. The Platform allows:

• Job seekers to create profiles and showcase their experience
• Employers to browse candidate profiles and post job opportunities
• Employers (via paid subscription) to initiate and conduct messaging with candidates

Gigster does not guarantee employment, hiring outcomes, interviews, or any business result. Use of the Platform is at your own risk.

User Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use Gigster. By using the Platform, you represent that you meet this requirement and are legally capable of entering into binding agreements.

Account Registration

Users may register through email and password, Google Login, Facebook Login, or Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized use of your account

Gigster reserves the right to suspend or terminate accounts containing false, misleading, or incomplete information.

Subscriptions & Payments

Gigster offers auto-renewable subscription plans available exclusively to employers. All plans grant the ability to message and contact job candidates on the Platform. The following plans are available:

• Starter Monthly — $79.00 USD per month
• Growth Monthly — $199.00 USD per month
• Starter Half Annually — $399.00 USD every 6 months
• Growth Half Annually — $999.00 USD every 6 months

Auto-Renewal: All subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.

No Free Trial: No free trial period is offered for any subscription plan. Payment is charged immediately upon purchase.

Cancellation: You may cancel at any time through your Apple ID subscription settings (iOS) or Google Play account (Android). Canceling stops future renewals but does not entitle you to a refund for the current billing period.

Refunds: All purchases are final and non-refundable, except where required by applicable law or platform policy.

Price Changes: We reserve the right to change subscription prices at any time. You will be notified of any price changes before they take effect.

Payments are processed by Apple App Store or Google Play Store, and you agree to the billing terms of the respective platform.

User Content & Conduct

You are solely responsible for any content you submit, including profile information, videos, photos, messages, and job postings. You agree not to upload or share content that:

• Violates any applicable law or regulation
• Is defamatory, abusive, harassing, or threatening
• Contains explicit, sexual, or graphic material
• Infringes the intellectual property rights of any third party
• Promotes scams, fraud, or misleading information

Gigster reserves the right to remove any content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

No Employment Guarantee

Gigster is a technology platform only. We do not guarantee job placement, hiring outcomes, interview opportunities, or the authenticity of any job listings or user profiles. Users interact with each other at their own risk.

Account Termination

Gigster may suspend or terminate your account for violating these Terms, engaging in fraudulent or harmful conduct, abusing the Platform, or for any illegal activity. Users may also delete their own account at any time from within the app.

Intellectual Property

All Gigster branding, software, designs, logos, and platform content are owned by Gigster or its licensors. You may not copy, reverse engineer, distribute, modify, or resell any part of the Platform without our prior written permission.

Limitation of Liability

To the maximum extent permitted by applicable law, Gigster shall not be liable for any lost profits, employment losses, user disputes, user-generated content, unauthorized access, data loss, or any indirect, incidental, or consequential damages of any kind arising out of your use of the Platform.

Use of the Platform is entirely at your own risk.

Disclaimer of Warranties

Gigster is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that job opportunities or user profiles will be authentic or verified.

Apple Licensed Application EULA

If you access Gigster through an Apple device, the following additional terms apply in accordance with Apple's standard EULA requirements:

• License Grant: Gigster grants you a limited, non-exclusive, non-transferable license to use the app on any Apple-branded device you own or control, subject to the Usage Rules in Apple's Media Services Terms.
• Apple's Role: Apple is not a party to these Terms. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support services for the app.
• Warranty: In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Product Claims: Gigster, not Apple, is responsible for addressing any claims relating to the app, including product liability, consumer protection, or intellectual property claims.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
• Export Compliance: You represent that you are not located in a U.S.-embargoed country and are not on any U.S. Government restricted party list.

Google Play Terms

Use of Gigster through Google Play is also subject to Google Play's applicable policies and billing terms. Subscription management on Android is handled through your Google Play account settings.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in the United States.

Changes to These Terms

Gigster may update these Terms at any time. We will notify you of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

Privacy Policy

Your use of Gigster is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.
